The IRS has released the details on how it’s implementing the Economic Stimulus Package payments. Due to the questions I received on the previous article on the Economic Stimulus Package I’ve decided to write on article that focuses on the details of the plan. I’ll address the FAQs (frequently asked questions) that I’ve received.

The US Congress passed and President Bush signed a bill authorizing an economic stimulus payment to qualifying US citizens. The bill was passed too late to be included in the 2007 federal income tax calculations. So instead of reducing your federal taxes or triggering a larger refund, the stimulus package will be a separate payment. However, it is required that you file a tax return in order to qualify for the payment.

How can I calculate my payment?

The IRS has a calculator on its web side that allows you to estimate your stimulus payment. I’ve included a link to this calculator in the article links section below. Essentially it will calculate the details of the plan for you. This may be important as not all taxpayers qualify for the payments.

Does Everyone Qualify?

Low Income
You have to show at least $3000 in qualifying income on your tax return. This means income from wages, or benefits such as Social Security, veteran’s benefits, railroad retirement. It does not include SSI (Supplemental Security Income).

Low-income workers who have earned income above $3,000 but do not have a regular filing requirement must file a 2007 tax return to receive the minimum stimulus payment. Similarly, Social Security recipients, certain Railroad retirees, and those who receive the veterans’ benefits mentioned above must file a 2007 return in order to notify the IRS of their qualifying income.

Did you know you may be able to file your taxes for free? Check out my article on free online tax filing for details.

High Income
If your single and make more than $75,000 or if you’re married and make more than $150,000 the payments will be reduced (phased out) depending on your income. According to the IRS, “[t]he payment, including the basic amount and the amount for qualifying children, will be reduced by 5 percent of the amount of income in excess of $75,000 for individuals and $150,000 for those with a Married Filing Jointly filing status.” So the more income you have over the limit the less of a payment you will receive. Rich people don’t need government money right? (Just kidding)

Dependants
Children and other dependants do not qualify directly. However, you will receive $300 for each qualifying child.

Will I Still Get a Payment if I Owe Money to the Government?

You may not get a payment if you owe back taxes or child support. The IRS is applying your payment to back taxes, child support, student loans and other debts. If you do owe money then you just received debt relief courtesy of Uncle Sam and the US tax payers. I’ll be expecting a thank you letter from every dead beat dad in the US.

When Can I Expect My Check?

If you filed electronically then you’re in luck. Those of us who filed electronically and opted for direct deposit (or in my case direct withdrawal) will receive our payments first. These electronic payments should be sent during the first half of May 2008. If you paid via paper check you will receive you payment later. Payments via paper check will begin during the second half of May and continue through July. So you could be waiting a while to get your check. I’ve include the payment table below.

Payment Schedule Update
The Treasury has announced that payments are going out sooner. Please see the my updated article on the new stimulus payment schedule.

What if I don’t Normally File a Tax Return

The IRS says that you have to file a tax return to get the payment.

The IRS emphasized that people with no filing requirement who turn in a tax return to qualify for the economic stimulus payment will not get a tax bill. People in this category will not owe money because of the stimulus payment.

I Have Other Questions

Leave a question in the comment section below and I’ll research the answer. Also, make sure you check the IRS website they have a large amount of information on the payment program.

If I file my 2007 taxes by 4/15/08, but do not pay the entire balance owed to the IRS, will I still get my stimulas payment, or must I pay the balance in full before I get the rebate.

  4. Marian on April 4, 2008 11:53 am

If your income exceeded the earned income guidlines to qualify for the earned income credit when you filed your taxes will that change the amount of the rebate you get back in the economic stimulus package?

  5. Chris on April 4, 2008 1:21 pm

It really shouldn't have anything to do with that. The only thing that should affect your stimulus payment is your total income (if you make too much you'll get a lower payment) of if you owe the government money (delinquent student loans, back taxes, etc.)

If you have questions you should probably talk to your tax preparer. They are in a better position to answer any specific questions regarding your tax situation.

I hate the fact that my money will be applied to back taxes I owe. The reason is because of the low income and that money will help with other bills. I feel the IRS should only take a portion not all the money that is given to me. Thanks for listening.

If I owe money to the irs, etc., will they allow you to make payments over a period of time?

  12. Chris on April 7, 2008 7:16 pm

    Jenna,
Did you file a tax return? Unless you owe the government money you should get a stimulus payment.

  13. Chris on April 7, 2008 7:17 pm

    David,
Direct Deposits are only for those who direct deposited their taxes. Unfortunately, you can't tell the IRS to direct deposit your payment now.

  14. Chris on April 7, 2008 7:21 pm

    Doug,
The IRS says that to qualify you "can't be claimed as a dependent on a tax return and have either an income tax liability or "qualifying income" of at least $3,000."

You should seek the advice of a tax professional if you think they may qualify.

  15. Chris on April 7, 2008 7:25 pm

    James,
You should contact a tax attorney. I really don't have any experience in dealing with the IRS directly. Someone who does it for a living can tell you for sure. Just look for "tax attorney" in the phone book or yellowpages.com. You should be able to find someone in your area.

  16. Donna on April 10, 2008 1:11 am

This is similar to another question, but I'd like to clarify if I may. Do I understand it correctly that if I claim my 17 year old daughter as a dependent on our return - she is a college student - she cannot qualify for the $300 on her own merits? She did not have enough earned income; however she did receive Survivor's Benefits last year. I do understand why rules are in place so that we AND she didn't get $300, but it seems like it could be one or the other.

  17. Chris on April 10, 2008 9:50 am

    Donna,
If she is a dependent than you will probably receive the $300 rebate for her (if you meet all the all criteria).

But the rules state that if you can be claimed as a dependent on another person's taxes, you don't qualify for the payment.

  18. Robin L. Daniels on April 11, 2008 11:39 am

I need to have my stimulas check mailed to me and NOT! direct deposited. My tax refund was however direct deposited. How can I prevent the stimulas payment from going into my bank account? Thank-You Robin L. Daniels

  19. Chris on April 11, 2008 11:45 am

    Robin,
You can contact the IRS before the week of April 13th. That means you have to do it today.

    Q. Is there something I can do to prevent my Stimulus Payment from being automatically deposited into the account that I identified for the Direct Deposit of my regular refund?

    A. Generally, if you designated Direct Deposit on a tax return, then the Stimulus Payment will go to the account number you designated. If the account number is no longer active, the IRS will send you a paper check. Under some circumstances you can prevent the payment from being automatically deposited.

If your regular refund has been deposited into your account via Direct Deposit and you contact the IRS before the week of April 13, the account information can be blocked to avoid the use of Direct Deposit for your Stimulus Payment. This will result in the issuance of a paper check that will be mailed to you.

However, if you contact the IRS on or after the week of April 13, the IRS will not have enough time to stop the Direct Deposit. In this situation, if you do not want your Stimulus Payment to go to the account listed on your tax return, you should contact your financial institution to discuss possible options. Finally, if the account number is no longer active, the IRS will send you a paper check. [Updated 4/4/08]

I filed my 2007 taxes and had to pay. Thus I did not include direct deposit info. Is there a way for me to still supply direct deposit data to the IRS, in order to have my Stimulus payment automagically appear in my account?

  21. Yellowgirl on April 11, 2008 4:24 pm

I've heard that you really are getting an "advance" of your 2008 tax refund, and that the stimulus will be deducted from any tax refund for 2008. Is this true?

  22. Toni on April 11, 2008 11:27 pm

I had my taxes done at H&R block. It was deposited to my mastercard. Will my stimulus payment go to the same place.

  23. Christina Stanley on April 12, 2008 9:00 pm

I have the same question as a lot of other people. I had my taxes done at h&R block to my mastercard , is there any way to get a direct deposit setup for the stimulus payment? My social ends in 98!!! I NEED that money sooner than that!

  24. Chris on April 12, 2008 9:33 pm

    Yellowgirl,
The stimulus payment doesn't have anything to do with 2008 taxes.

    Toni and Christina,
Unless the IRS has your bank account information and your directly depositing to a bank account then you're going to get your stimulus payment via snail mail. Sorry.

  25. Jeff on April 13, 2008 12:41 am

I also read that the stimulus payment is technically an advance of 2008 special tax credit. Also, if you don't qualify for any or all of the stimulus payment this year based on your 2007 tax return, you can use your 2008 tax return to qualify next year.

The IRS website is clear, however, that the stimulus payment will not affect your taxable income for 2008 or any refund that you may receive.

  26. justin on April 13, 2008 11:01 am

I'm trying to confirm how much I will receive from the stimulus package. Having earned 6,539.00 and not having owed the government anything, actually I received 855.00 in earned income credit. Does that mean my check will only be 300? I am single with no children and filed a 1040a. Thanks for your time.

  27. Chris on April 13, 2008 11:03 am

    Justin,
Use the calculator on the IRS web site to figure out exactly what you will get receive:
    http://www.irs.gov/app/espc/

  28. justin on April 13, 2008 11:10 am

    Chris,
I used the calculator on the IRS web site before coming here, but I e-filed and on the print out I received upon finishing did not have the normal numbered lines…like #35 which you have to have to figure out the number of credits you recieved. I don't believe thats talking about E.I.C. but on my turbo tax form it says "Total Payments/Credits" so I wasn't sure if the 855 in E.I.C. would count under total credits. It probably would count under Total number of payments instead. I hope that wasn't too jumbled up and confusing.

  29. Chris on April 13, 2008 11:16 am

    Justin,
    According to the IRS Site:
"Some people with no tax liability also will qualify. This includes Social Security and Railroad Retirement beneficiaries, recipients of certain veterans’ payments, low-income workers with earned income and/or benefits of at least $3,000 and individuals who have combined income of at least $3,000 from any combination of these sources."

I can't see any reason why you wouldn't get the full $600. Is there something specific on the IRS site that makes you think you won't get the full payment?

  30. justin on April 13, 2008 11:27 am

"Examples of how the Economic Stimulus Act of 2008 may affect taxpayers who are single and either childless or do not have children who qualify for the child tax credit:
    1) Individual with wages of $4,000, no federal income tax liability.
    Individual rebate is $300″

That is from the same website and is very close to my situation. I only made a couple thousand more than that for the whole year and didn't pay anything in. I saw another piece of info that said if you didn't pay anything in and had no kids you would probably only get 300. Im not sure if that was off of the irs website though…i can't find it again.

  31. Sharon on April 13, 2008 12:17 pm

If you are in a nursing home and you are from Italy receiving also income from an Italian Pension, Do you have to report that for you stimulus payment if you are a citizen in the us. She gets 2 checks of income one from Italy and one from us. Do you only report us income for your stimulus rebate check. Thank you Sharon

  32. Chris on April 13, 2008 1:11 pm

    Sharon,
This income is for your tax return not just your stimulus payment.

You should consult a tax professional.
    Thanks

  33. Chris on April 13, 2008 1:20 pm

    Justin,
I think the page you're referring to is http://www.irs.gov/newsroom/article/0,,id=179169,00.html.

There is a list of examples here:
    http://www.irs.gov/newsroom/article/0,,id=179213,00.html

Yes, it appears that lower income tax payers could receive as little as $300. It appears you have to have some tax liability to receive a higher payment.

  34. Chris on April 13, 2008 1:25 pm

    Jeff and Yellowgirl,
If you are not eligible this year, the IRS says:
"If you're not eligible this year but you become eligible next year, you can claim the economic stimulus payment next year on your 2008 tax return."
    Source: http://www.irs.gov/newsroom/article/0,,id=179211,00.html

I'm not sure what the wizardry is behind the scenes that makes this all possible. However, I haven't found any sources that say this payment will lower your 2008 rebate.

My sister has a 17 year old who has qualifying income. My sister doesn't need to claim her daughter on her taxes, because her tax liability will be zero anyway. Can she NOT claim her daughter so that her daughter will qualify for the stimulus check?

if youre on and (aide to needy disabled) can you file for the dtimulus package? aj friend keeps calling me and telling me I can.

  37. Chris on April 13, 2008 8:21 pm

    Jim,
I believe as long as someone "can" claim you as a dependent than you don't qualify. Also if the daughter has only a small income she wouldn't qualify for more than $300 anyway.

You can use the IRS calculator to find out.

  38. Chris on April 13, 2008 8:28 pm

    Valerie,
You need to have $3000 in qualifying income.
    The IRS says:
"Qualifying income includes any combination of earned income and certain benefits from Social Security, Veterans Affairs or Railroad Retirement."
You need to file a tax return even if you don't normally file one to be eligible for the payment.

You can file online for free at http://www.irs.gov/efile/lists/0,,id=179739,00.html. It's free if your income is under a certain limit.

Since your filing an extension it means you haven't actually submitted your tax return yet. You won't be eligible until you actually file your return.

If you don't qualify this year, you can file for a credit next year.

  43. Chris on April 14, 2008 1:09 pm

    Wanda,
The IRS uses your tax return to figure your stimulus package so you've already claimed your 19 year old.

I am 65+ and retired. I opt to have $50.00 a month taken out of my small retirement pension as income tax withheld. I get this full amount back at the end of the year. Will this stimulas payment this year be taken out of that income tax return for next year? If this is so, then should I stop the income tax withdrawal from this year?

  48. Chris on April 15, 2008 10:41 am

    Barbara,
The stimulus payment isn't "taken out" of your tax return. It's a separate payment from the government. The government uses your tax return to make sure you qualify for the payment.

The stimulus payment won't affect how much tax you owe or get back as a refund.

    Thanks

  49. Amber on April 15, 2008 11:21 am

I'm very frustrated. As a recent college grad. I allowed my mother to claim me last year even though I worked very close to full time as a student and did work full time from May on after I graduated. Because I was a student exactly 1/2 of the year I allowed my mom to claim me (b/c she gets greater benefits with me as a dependent) with the understanding that she would make up the difference in the refund I would be getting. When the stimulus pckg came up we decided that she would give me the $300 that she got for having a dependent plus $300 to make up the fact that I helped her and that I wouldn't be getting a stimulus pckg of my own (even though I earned one). Now come to find out that you only get the additional $300 for dependents under 17. So I guess that means if you are a college student working your ass off to pay for school to help your parents and just to live (like I had to do for 5 years) then you just get screwed over. Its just another way of America telling the 18-24 bracket that they don't count!

You should get your stimulus check after you file. You'll probably get it later than if you had filed on time.

  52. Robert on April 15, 2008 9:27 pm

For the government to say this money is to stimulate the country. Then to say if you owe money (school loans/back taxes). They will keep it, is just outragous…… Child Support is ok since the government is not receiving it someone else is going to. I thought the whole part of barrowing money from china, is to keep us out of a repression, that we are actually in. Then saying that the goverment is going to keep it is just plain stupid….

1.) I am owed child support from ex husband will i be receiving his stimulus money instead of him receiving it
2.) My daughter receives money from social security (death benefits) for her children does that money count towards the stimulus package that we are suppose to receive in may or june

  54. Chris on April 16, 2008 8:34 am

    Sheila,
    Those are good questions.

    1.
I'm not sure if you will receive your husbands stimulus money. He has to file a tax return to qualify. Is he filing taxes?

According to the IRS [http://www.irs.gov/taxtopics/tc203.html] if your husband owes child support than any refund he is entitled to should go to you anyway.

    2.
Did your daughter file a tax return? You can check the IRS page for Social Security recipients at http://www.irs.gov/newsroom/article/0,,id=179201,00.html.

She has to have $3,000 from any qualifying income source to get the payment.

  55. sheila on April 16, 2008 8:41 am

1.) yes my ex tiled a tax return and i am getting the refund from his original return, just was not clear about getting the stimulus refund also.
2.) yes my daughter filed a tax return but she only had 1,100. in actual money earned (college student) but had over 11,000. in social security death benfits that she received for the 2 children…just wanted to know if she would be entitled to the $600 for herself and $300 for each of the 2 children.

  56. Chris on April 16, 2008 9:14 am

    Sheila,
If you daughter filed a return she can use the IRS calculator at http://www.irs.gov/app/espc/ to see exactly how much she will get.

If she needs to update her return (to claim the Social Security benefit income) she can file an amended return with the IRS. The amended form is here: http://www.irs.gov/pub/irs-pdf/f1040x.pdf

    Amber,

I totally agree with you! I work my ass off so I never have to ask my parents for money, yet since they claimed me as a dependent, I don't get a damn thing! It makes me so mad because I know this country thinks that anyone who goes to college has rich parents that give them anything they want. Well, I'll be damned b/c my parents cut me off years ago. I found out the government was giving out a couple hundred extra dollars to those who made over $3,000 last year…but then when I read that you can't be claimed as a dependent, I was pissed! Totally unfair.

In order to qualify they need to file a tax return.

In situations like this I recommend a professional tax preparer. A professional is going to understand how to handle their unique situation.

Once the tax return is complete they can use the IRS payment calculator at: http://www.irs.gov/app/espc/.

If my only income ($6408)is from Social Security, can a company, "Fingerhut" withdraw my direct deposit Stimulus Payment from my bank account for a delinquent debt? My sole income is from the government.

  69. Chris on April 23, 2008 12:53 pm

    Reno,
That's a loaded question. In some states creditors can do a bank draw. That means the sheriff goes to the bank and withdraws your money to pay your bills. However, this is only legal in some states.

The government will only withhold your payment if you owe money directly to the government or for child support.

  70. Nancy on April 23, 2008 4:09 pm

Turbo Tax made a technical error when I filed my original 1040. I noticed the error when I printed out my tax forms a few days later. (Mind you I already sent the original info via Turbo Tax). For whatever reason, Turbo Tax did not include my 16 year old son as a dependent. When I noticed the error, I immediately corrected it by making an 1040X-Amended Return. I sent this via the US mail the same day I noticed the error. Today, I called IRS and asked about the Stimulus check and did I send the 1040X in time so that my son would be included in the rebate? I was told "NO". IRS will only figure the Stimulus check amount on the original return and not on the Amended return. Which means instead of receiving $900.00, I will only receive $600.00.
I can't believe my dependent/son will not qualify because of a technical error on Turbo Tax's part. Will I ever receive the extra $300.00, which I am legally entitled to?

  71. Chris on April 23, 2008 10:08 pm

    Nancy,
Possibly. The IRS site says that you can claim the stimulus payment next year as a tax credit if you didn't get it this year.

In your situation you might have to use a tax preparer. Tax software isn't always the best at handling "unique" situations.

Also, you can wait for your payment. You never know, you might still get the extra payment for you child. Depending on who you talked to they may or may not be correct.

  72. Nancy on April 24, 2008 7:00 am

Thanks so much Chris! After using Turbo Tax for over 10 years, this is the first time it dropped my son as a dependent. Go figure…but hopefully if not this year, then next year I will get the extra $300.

  73. Cherie on April 25, 2008 9:29 pm

    Hi Chris -
I have a similar situation to Nancy. My 1 year old niece and 3 year old nephew live with me, and I provide the majority of their support. I am single and filed my original 1040 return as single with no dependents, not realizing I was entitled to claim head of household with 2 dependents. Immediately upon receiving my refund, I filed a 1040x to amend my return with the correct filing status and reflect 2 dependent children. I have not received my additional refund yet although it has been over 10 weeks since I mailed my amended return. The IRS tells me nothing more than "it's being processed". Today, they told me I would not receive the additional $600 rebate for the 2 dependent children on my revised return, as they will base their rebate payments solely on the original 1040. How can they get away with this?

  74. jeanie on April 25, 2008 9:39 pm

So many different answers. So i will ask here. We filed jointly, he made 23.000, i get disibility, and do not have to claim on taxes. So do we get 600.00between us or 600.00 each. everyone i ask has a differant answer. What do you think?

  75. Chris on April 26, 2008 7:42 am

    Jeanie,
Grab your tax return and go right to the source: http://www.irs.gov/app/espc/

The IRS calculator will calculate what you will actually get. The rules are too hard for most people (including myself) to figure out without using the calculator.

  76. Chris on April 26, 2008 7:43 am

    Cherie,
You may be entitled to a credit on your 2008 tax return if you don't get the full amount. Make sure you write down a note about this and talk to a tax preparer next year.

  77. melanie on April 26, 2008 5:31 pm

hi, I got a RAL loan with H&R Block this year and last year, but choose to file independently and for two years my refunds have been direct deposits into my bank account. so my question is, will i still get the 2007 stimulas check wired to my bank account now or willl they send the stimulas check in the mail?

  78. Chris on April 26, 2008 11:22 pm

    Melanie,
If you used any kind of RAL, you will get a paper check in the mail.

    Q. I chose direct deposit for my 2007 tax refund but also requested a Refund Anticipation Loan (RAL) from my preparer. How does that affect my stimulus payment?

    A. Taxpayers who use RALs or enter into any other loan or financial agreement with their tax professional cannot receive their stimulus payments by Direct Deposit and instead will get a paper check.

  81. Chris on April 28, 2008 11:21 am

    Jill,
I wouldn't count on getting a check. The IRS is pretty clear about withholding payments from those that owe the government money and specifically for student loans:

    Q. I'm eligible for a payment but I still owe federal income tax from a prior year. Will my payment be reduced?

    A. Yes. For this purpose, the Stimulus Payment is treated like any other tax refund. This means that part or all of your payment can be used to pay past-due federal or state income taxes or non-tax federal debt such as student loans and child support.

    Q. How will I be notified if my stimulus payment was used to offset an outstanding debt?

    A. If this occurs, you will receive a letter explaining how the Stimulus Payment was applied.

    Source: http://www.irs.gov/newsroom/article/0,,id=179181,00.html

However, they do say they will send a letter if they withhold your payment.

Why don't we get the $300. for children age 17? They are not considered to be adults and we pay more money to support them then we do for younger children.

  87. Christine on April 28, 2008 10:16 pm

I think it is wrong that people on SSI won't get the payments. They get a lot less money a month and sure could use a boost!! It seems funny that with such low income that they wouldn't be the first to recieve it.

  88. Jennifer on April 29, 2008 8:13 am

I was wondering how having to amend our taxes is going to affect the stimulus. We have already filed 2007 taxes, but need to amend, as we are due more of a refund. Will this affect our check?

  89. Chris on April 29, 2008 8:23 am

    Jennifer,
It could affect your payment. If you are in the "low" or "high" income category or if you change the number of dependents you claim, it could affect your check.

  90. Desarae on April 29, 2008 8:58 am

I Used HRBlock TaxCut to prepare my own taxes online. I paid them using thier Simple Pay option. (Meaning that my money was direct deposited into HRBlock Bank, and then they took thier payment ($29.00) and then direct deposited my money into my account. I did not recieve a RAL. I got my money in 8-15 days. My tax return shows HRBlock Bank Routing and Account Numbers on it.

  91. Desarae on April 29, 2008 9:03 am

I guess I can ask my Question LOL. Will I recieve a check or Direct Deposit?

  92. Chris on April 29, 2008 10:07 am

    Desarae,
Generally, if you didn't use your own personal account for the direct deposit info, you will be receiving a check.

This is based the current info I have from the IRS, anyway.

  93. Donna trentham on April 29, 2008 10:12 am

I have a question me and my husband had our taxes done by h&r block the end of january we have already received all our refunds our money was put on our emeral card for that card there is a paper in our taxes that states IRS direct deposit there is a routing number and account number so will the economic stimulus payment go on our card

  94. Chris on April 29, 2008 10:19 am

    Donna,
Generally, if you didn’t use your own personal account for the direct deposit info, you will be receiving a check. So unless that routing number and account number belong to you, you will get a paper check.

  95. Randi on April 29, 2008 11:21 am

Question: I keep seeing things about the govt applying your stimulus payment to past due loans. Is this only true if you owe the govt money directly? We have a lot of debt with credit card companies, but we do not owe back taxes or child support. We do have ONE student loan, but we make regular monthly payments on it, and we are NOT behind on those payments. Will any of this affect us getting a stimulus payment? Just curious… thanks!

  96. Chris on April 29, 2008 11:32 am

    Randi,
You don't have to worry unless you are behind on your student loan payments or owe back taxes.

  97. Randi on April 29, 2008 11:42 am

Okay, thanks. I did the online calculator at the IRS website last week and it estimated my refund for me, however, I have not received anything in the mail telling me that I am actually getting a refund and how much I can expect. The only thing i ever received was the generic mailing that said "you may be eligible for up to $1200 plus $300 per qualifying child". Is this an indication that I won't be getting a refund, if I haven't gotten the letter stating the amount I will receive? Sorry for all the questions, but in our current situation, we sure could use any extra $ we can get…

  98. Chris on April 29, 2008 11:54 am

    Randi,
If the calculator shows you should get a refund then you should get one.

I don't believe you will receive a letter indicating the amount you will get. Have a you read something that indicates you will? If so can you leave a link to the website that said that?
    Thanks

  104. Chris on April 30, 2008 8:38 am

For those of you using TurboTax please check out my article on the Economic Stimulus Payment and TurboTax.

  105. Chris on April 30, 2008 8:41 am

    Jo Ann Ginder,
I believe it's probably a logistical problem. By that I mean the IRS wasn't really prepared for something like this and I'm guess there are a lot of IRS employees and contractors working overtime just to make the stimulus payment happen. Considering it falls right during the busy tax season, it's a wonder they can get this done at all.

But yes, it would be nice to get our payments right away!

  106. Julie on April 30, 2008 10:14 am

Are the directly deposited economic stimulus amounts subject to confiscation by the bank for past debts owed to the financial institution?

In other words, if a rebate tries to post electronically to a closed account for a customer that owes the bank money, can the bank offset the amounts owed to them and send the taxpayer a check for the remaining amounts?

Or must the bank simply return the rebate because the account is closed?

  107. Chris on April 30, 2008 10:38 am

The money should be returned to the IRS.

We only make a combined income of about $48,000 a year, we have three children, and my husband is in the military and we are stationed overseas. I was wondering if because we are stationed overseas does that exclude us from being qualified for the stimulous?

  128. Chris on May 4, 2008 7:43 am

  144. Richard on May 11, 2008 7:04 am

Let me tell you something you sanctimonious self-righteous pontificating moron.

There are far more obligated Mothers that don’t pay child support than Fathers. Why no “Deadbeat Mom” phrase? Check it out…Mothers get a pass and Fathers go to jail. Further the truth is there are thousands of women that live off of child support, denying the children of whom the money is intended for their own selfish needs and wants. Far too often Fathers are paying court ordered support and find that their children are going without basic necessities and end up buying things that the Mother should be buying with the support money. The courts turn a blind eye towards this abuse in a sick favoritism towards Mothers. Most men that pay support can hardly afford to live themselves and can’t afford expensive legal representation that will most likely end up in favor of the abusive Mother anyway.

The insanity of awarding custody to Women that can’t even support themselves let alone take care of children continues. The Family Courts are corrupt, unfair and irrevocably damaging the lives of Fathers and their Children. When will the insanity stop?

The SSN was NOT omitted and was correct. At that time the rep told me that she would correct this and while my refund would be delayed it would come. Today I checked the status of my stimulus pymt and it is scheduled for DD on 5/16, but is reduced by $410! Today's rep told me that the payment could not be corrected, as it was based not on my return, but on the IRS'S INCORRECT INPUT OF MY RETURN! Just too bad, so sad. He said that I "may" be able to get a credit for 2008 for the missing amount. What in the world?!!! "MAY" get what I am not getting now due to their stupidity? Surely that is not correct. . . . ??

Will I Still Get a Payment if I Owe Money to the Government?

You may not get a payment if you owe back taxes or child support. The IRS is applying your payment to back taxes, child support, student loans and other debts. If you do owe money then you just received debt relief courtesy of Uncle Sam and the US tax payers. I’ll be expecting a thank you letter from every dead beat dad in the US.

Not such a good stimulus plan there.I thought it was for the economy!Stimulus check is for the economy. Not b.s. creditors that are already stacked with cash.

I have delinquent student loans, I fell on hard times and had to choose between eating or paying the loan.

They took my tax return, and I was assuming they were taking my stimulus check.

I just got a notice that I have $600 coming to me for the stimulus package, I read that they would send me a letter if I don't qualify, and I would get nothing, I also read that if I was getting something I would receive a letter with the amount.

Does this mean that even though I have delinquent student loans I'm still getting a check?

  151. Chris on May 13, 2008 9:25 pm

    Empty,
I wouldn't count on it. According to the IRS site they can take your stimulus payment in the same way they claimed your refund.

When I had my Stimulus form done, I asked to have my payment Automatic Deposited. I asked
if a voided check needed to be given for this to be done. I was told no, that if I had my Social Security check Auto. Dep. (which I do)

That was all that was needed. The date for the deposited has passed and no payment has come in. I pulled the copy of US 1040 and after looking at it again. Where it says Refund Line 74a where my routing number and checking account number should be she X it out. So does this mean I will be getting a
    paper check.

    Thank you for your help.

If that information isn't on your tax return, I don't see how the IRS would know your direct deposit info. I would look for a paper check in the mail.

I cannot get hold of the IRS to speak to a LIVE person and am moving to Denver soon… how do I find out what's going on?

  161. William R Newcome on May 15, 2008 3:17 pm

I am tired of everytime someone talks about child support the always say Dead beat Dads. I take serious offense to that statement. I paid child support for 10 years and I never missed a payment. At that time it wasn't taken out of my check. It was my responsibility to pay it and on time. My daughter decided to start living with me last June and I have fought with the system up until March to start getting child support paid to me. Bottome line is there are Dead beat moms out there and society needs not forget that.

  162. Patricia on May 15, 2008 9:49 pm

Andrew-Go to irs.gov "Where's my stimulas check" and put in info it ask for. It will eaither tell you or a page will come up (like I got) saying they can't tell me anything at this time to call this number and Ext. I was on hold for an hour to be told it would come in the mail.

I am a sigle parent with a child who is in college. Since I pay for his college, and claim as a dependent, I don't get anything for him since he is over 17. He works and goes to school, filed a tax return, but did not claim himself, since I do. He doesn't get a stimulus package. What about all the collge kids who could use the extra money, but somehow get left out of the stimulus package. How fair is that?

  164. emily on May 16, 2008 11:41 am

    Emily,
    Yes, you should.

  166. Lindsey on May 16, 2008 1:23 pm

So I am confused.. my mom claimed me as a dependent on her return this year. I am 21 years old, go to college full time and work 2 jobs. I pretty much support myself all year, with my mom giving me some extra cash here and there. I filed a tax return this year as well, but since my mom claimed me as a dependment (which I did not know she was doing) does that mean she or I will not receive the stimulus check for me?

  167. Ron on May 16, 2008 3:54 pm

I filed online with H&R Block, got a refund & had it direct deposited. My SS ends in 91. I was thinking I'd get my $ on May 16th. I used Simple Pay Fee with H&R Block. Will that negate the direct deposit? The IRS site says "If filing or preparation fees were deducted from your 2007 refund or if you obtained a refund anticipation loan or other bank product related to your regular tax refund, you will receive a check instead of a direct deposit." Just my luck. Thanks for any help.

  170. Chris on May 16, 2008 9:06 pm

    Ann,
They would need to complete a tax return, if they didn't already. If they did complete a tax return then you can estimate their payment using the IRS calculator: http://www.irs.gov/app/espc/

  171. Chris on May 16, 2008 9:11 pm

    Franz,
AFAIK, the gov't is only collecting gov't debts.

  172. Chris on May 16, 2008 9:20 pm

    Lindsey,
B/c your mother claimed you, you will not get a stimulus payment and you are too old for the child credit payment.

You're one of those unfortunate ones who are stuck in the middle. However, you mom did get the tax benefit of claiming you on her taxes. Hopefully she'll at least buy you lunch or something.
    Hang in there!

  173. Nancy on May 17, 2008 10:23 am

    Chris:

I wrote to you a few weeks ago about filing an Amended return 1040X because Turbo Tax had a
tech error and deleted one of my children who is under 17 years old. Because of the error I will only receive $600.00 and not $900.00. Next year I will receive the other $300.00(fingers crossed) when I file my taxes.

Now the issue at hand: I received Direct Deposit right from the US Treasury for my tax refund. I just found out this morning (per automated calling) that I will be getting a paper check (automated calling says it will be mailed on May 23)because I filed an 1040X. Except it won't include the extra money for my dependent….unbelievable! It gets better…my social security number ends in 89 and by the IRS website calculator, I should get a paper check sometime in July.

Is it me or am I the only one who feels like I am a puppet on strings being pulled every which way by the IRS? Now I really don't know when the money is coming. What is your take on this big mess created by the Feds? I know I am not the only one who is being jerked and pulled around by IRS. It would have been better if they had just mailed or Direct Deposited the refunds without telling the tax payers. That way it would have been a really nice surprise instead of this hair pulling and wailing and gnashing of teeth-nail :-)

So, he tried to cash it at Walmart but would not take it either because he crossed out my account number on check.

I have been searching online to find where I can go or who I need to call to have his check reissued(it's 300 dollars gone bad). Can someone help me or tell me what steps I need to take to get his check reissued to him. I hope someone can help!!!:(

  176. Jenny on May 20, 2008 10:38 pm

Have you tried depositing the check into your checking account instead of trying to cash it. You might have to wait a few days for it to clear but at least you don't have to wait for the check to get reissue

  177. Patricia on May 21, 2008 7:04 am

Coourtney-Have you tried those check cashing places? They takes 3% of the check amount but it would be better then nothing. I would also try going back to Wal-Mart because sometimes a different person will do it or even ask to speak to a manager and explain why your account was crossed out. It would be worth a try.

My husband and I got our stimulus money on 5-9-08 and I had been to the irs.gov calculation page. This page said we were to get $1500; and that was pulling figures from our taxes that we filed in Feb 08. We received $1200. What is up with the difference? The way the calucator page had it figured, $1200 for us and we were supposed to get $300 for 2 of our 3 kids. Any insight would be greatly appreciated.

  196. Crystal on May 29, 2008 7:30 am

Is this just bullsh*t to me or does everyone agree? However according the irs.gov my check is supposed to be issued or received by the 30th of May but since the checks started to go out early I thought maybe it should have been here by the 23rd (wishful thinking). No check I called the stimulus hotline # and was told by the rep that my check has not been mailed as of yet. Now I've gotten both letters the first one letting me no about the stimulus check and then I got a letter saying that I was due a check and the amount and 24 hours from the day I thought I was getting my check I'm being told that I wont see it until the second week of June how did it go from May 30th to the second week in June. I feel like the IRS really played me because #1 yes I did my taxes at Jackson Hewitt but I waited the 15 days for my refund yes the deducted the fees from my refund but I waited and yes it was direct deposited so I feel like my stimulus should have been direct deposited as well and now their telling me I have to wait till the middle of June for something that I was told that I should have by the 30th of may. I bet that if I have to pay by the 30th of May and told them that I couldn't pay it until the middle of June the IRS would go for it! What can we do about this because I feel like this is ridiculous! The last two digits are 25 and I'm expecting 1200. I don't need the government baby sitting my money I have a account where I can that myself. How can I put back into the economy what I don't have and by the time I get it I'll have to do something else with it like pay bills. What bothers me the most is that I have to wait and wait and wait. For what? I work 5 days a week so it's not like I spent out expecting or hoping I would get it before something clears my account or something get past due it just the fact that it's mine and I want it.

My question is is can they take it for anything eles? My husband has a jugdment against him because he owes money for a reposessed car and they always take his state refund. They never touch the fedral refund just the state. So my question is is can they take our stimulus payment?

  208. Chris on June 13, 2008 12:31 pm

Once you file your taxes, the IRS should send out the payment within 12 weeks. So the sooner you get your taxes done, the sooner you get your rebate.

My checking account was just garnished (everything except $1.65) from a creditor back in 1999. I am a single mom with two kids and now my rent is not paid for July and my paid check are going to be garnished. Does this mean I will not get an economic stimulus check? Will it go to the creditor? My check was suppose to be mailed on June 27th and I have a feeling they got it before me. Just like they got into my account before my landlord cashed the check. I am a complete stress ball.

  217. Chris on June 28, 2008 4:15 pm

    Heather,
The IRS is only withholding money for federal debts. I have not heard of them withholding money for private debts.

Has your debt been completely satisfied now?

If it hasn't you may want to just cash the check and pay your rent. Wal-mart is cashing the checks for a few dollars. That way if they do another draft you'll at least have your rent paid.

  218. Heather on June 28, 2008 6:53 pm

    Chris,
thanks for the reply. It made my day alittle brighter. I will cash it at Walmart. Another question? We are laying off at my company like crazy. If I get laid off would the creditor be able to garnish my unemployment checks here in CA. I owe 5k so they are just trying to take everything from me.

I filed my return at the beginning of March. I had to pay this year. The IRS had no problem cashing my check, however, I still have not received my stimulus payment that I was supposed to recieve on May 9. When I called the IRS last week, they advised me that my return has not even been processed yet and could not find it on file. I was then advised to resubmit my return. What gives and what do I do? If I refile, knowing the IRS and how incompetant they are. I am almost certain they will try to hit me with penalties for not filing on time. Even though my check was cashed in March. All of this is holding up my rebate. What gives and what are my rights?

    Rhonda,
If you don't receive you payment this year, you can claim it on your taxes next year.

How much work to you want to go through to get your stimulus payment? You might want to contact a tax professional if you're expecting a large check. Otherwise, claim the credit next year.

I mistakenly entered wrong SS# for my dependent daughter on my tax return. I was able to correct this error with an IRS rep. over the phone. Because of the initial error with the SS# I did not receive any stimulus money for my daughter….which I believe to be $300.00. Is there any way to rectify this? I have tried calling the various help numbers and have found them to be deadends. Thank you kindly,
    Diane

    Diane,
You can claim the tax credit on your 2008 taxes.
That's the only way I know of to get that money. As far as I know the IRS will not issue another check this year.

I'm 25, I am not a student and have been out of school for 3 years, and I work a full time job. My filing status is Single and I claim 0 on my return. I've been filing my own return since I was 17. I used the IRS URL "https://sa2.www4.irs.gov/irfof/IRServlet?app=IRACTC" to check on the status of my stimulus check and I'm told that I was claimed as dependant and am not elibile to receive it. First, how can I possibly be claimed as a dependant when I'm over the age of 17? Second, who could possibly legally claim me as a dependant when by tax definition I am comletely independent? I'm concerned that my SSN has been fraudulently used and I can't get a hold of anyone at the IRS by phone because of incredibly long wait times. I know the longer I wait on something like this, the worse it can get. Can I find out who claimed me as a dependant? Thank you for your time.

Well I finally got in touch with the IRS and I was told that my taxes were filed incorrectly so I'll have to get with my CPA about that. Thanks anyhow!

    Cody,
I would give it a week. If you don't receive your check by Friday, try contacting the IRS.

    Good Luck
